I, Alicia Fairbourne, Hideout Town Clerk, do hereby certify that the following is a full, true and correct abstract of the statement of votes cast for the Silver Meadows Referendum Election held on June 22, 2021.
Proposition 3: On October 16, 2020, the Town Council of Hideout passed Ordinance No. 2020-10 which annexed the Silver Meadows Annexation of approximately 350 Acres into the Town of Hideout Boundary and Amended the Official Zoning Map. This annexation will take effect only if approved by the voters. Are you for or against the annexation taking effect?

We, the Hideout Board of Canvassers, hereby declare the number of votes for the Silver Meadows Annexation taking effect exceeded the number of votes against, and were submitted only by the voters residing within the boundaries of Hideout.

TOWN OF HIDEOUT PROCLAMATION
2021-1
PROCLAMATION DECLARING ORDINANCE 2020-10 WHICH WAS THE SUBJECT OF A REFERENDUM PETITION AND WAS APPROVED BY A MAJORITY VOTE TO BE IN FULL FORCE AND EFFECT AS THE LAW OF THE TOWN OF HIDEOUT
On October 16, 2020, the Town Council of Hideout passed Ordinance No. 2020-10 which annexed the Silver Meadows Annexation of approximately 350 Acres into the Town of Hideout Boundary and Amended the Official Zoning Map.
Pursuant to Utah Code 20A-7-6, Ordinance No. 2020-10 was the subject of a referendum petition. The requirements of the referendum were met and the referendum was taken to a vote in a special election on June 22, 2021.
The voters of the Town of Hideout voted on the following question:
On October 16, 2020, the Town Council of Hideout passed Ordinance No. 2020-10 which annexed the Silver Meadows Annexation of approximately 350 Acres into the Town of Hideout Boundary and Amended the Official Zoning Map. This annexation will take effect only if approved by the voters. Are you for or against the annexation taking effect?
The votes on the proposed law that was the subject of the referendum petition were counted, canvassed, and delivered as provided in Title 20A, Chapter 4, Part 3, Canvassing Returns.
The local clerk has certified to the Town of Hideout Town Council the vote for and against Ordinance 2010-10 that is the subject of the referendum petition.
On June 22, 2021 Judge Jennifer Brown issued an oral ruling on case 200500107 Summit County v Hideout in the Fourth District Court on the legality of ordinance 2020-10 and granted Summit County’s motion for summary judgment finding that ordinance 2020-10 was not valid because Ordinance No. 2020-10 became effective after October 26, 2020 and its Certificate of Annexation from the Lt. Governor’s office is dated October 28, 2020. That oral ruling has not been finalized.
On June 29, 2021, the local board of canvassers completed the canvass.
Now therefore, the Town of Hideout Council acting as the local board of canvassers pursuant to Title 20A, Chapter 4, Part 3 and Title 20A, Chapter 7, Part 6, hereby proclaims:
- VOTES.
- The total number of votes cast in the Town of Hideout was: 269
- The total number of votes for the proposed law subject of the referendum petition was: 182
- The total number of votes against the proposed law subject of the referendum petition was: 87
- The Majority Vote approved Ordinance 2020-10.
In accordance with Section 20A-7-611, the Town of Hideout Town Council hereby declares Ordinance 2020-10 which was the subject of a referendum petition was approved by majority vote and is in full force and effect as the law of the Town of Hideout subject to any rulings of the Court or appellate courts and any appeal therefrom.
